I noticed that this blog as been inactive since March of 2011, so I thought I would attempt to re-kindle a coversation, and not necessarily on the BOA post immediately preceeding.

Regaring impermissible provisions in confimed Chapter 13 plans, are they binding? Take, for example, a confirmed Chapter 13 plan that crams down a 910-car. Does the secured lender have to release its lien in the event the cram down amount is paid, the debtor completes the payments under the plan and a discharge order enteres?

In addition to "shutting everyone up," which I usually verbalize as giving the creditors someone else to yell at, the true salutary effect of a small corporate Chapter 7 is to bring to a halt (and end) the lawsuits against the company.

The filing avoid the consequences of the natural practice on the part of the principals of throwing the suits in a drawer, if not the trash, and ignoring them, which leads to them ignoring the notices of judgment, the post-judgment interrogatories, the motions to compel/for contempt and the REAL potential for a trip downtown to explain to the judge why you're choosing to ignore his/her orders. Worth the $$$.

Ron,

A former boss hired me to be the general manager of a small telephone company, Meriplex Telecom (a subsidiary of Meriplex Communications). Thus, I no longer practice bankruptcy law.

I still follow the happenings in Austin's bankruptcy world. I just wanted to tell you that your blog and website are outstanding. Keep up the good work.

I wish I'd known this a month ago. A prospect with a GMAC loan has just done a short sale on her home because they wouldn't do the loan mod.
